These Terms & Conditions (“Terms”) govern your use of the website, online store, social media sales channels and other sales services operated by Vintage Authentic Room Limited (“Vintage Authentic Room”, “VAR”, “we”, “us” or “our”), a company incorporated in Hong Kong with limited liability.

By accessing our website, placing an order or purchasing from us, you agree to these Terms.

Nothing in these Terms excludes or restricts any consumer right or remedy that cannot lawfully be excluded or restricted.

Vintage Authentic Room specialises in genuine vintage, retro and collectible football/soccer jerseys and related merchandise.

2. Vintage and Pre-Owned Products

Many products sold by us are vintage, pre-owned, discontinued or collectible items.

Due to their age and history, products may display signs of ageing or previous use, including fading, pulls, loose threads, marks, minor stains, cracking to prints, repairs or other wear.

We make reasonable efforts to disclose material defects and notable condition issues in the relevant product listing and photographs.

A condition issue that was clearly disclosed before purchase will not, by itself, mean that the product was incorrectly described.

Unless otherwise stated, product photographs are intended to show the actual individual item being offered for sale.

3. Authenticity Guarantee

Vintage Authentic Room guarantees that every item sold by us as genuine or authentic is genuine and is not counterfeit.

We assess products using information reasonably available to us, which may include:

• manufacturer and brand details;
• product codes;
• labels and wash tags;
• materials;
• stitching and construction;
• design characteristics;
• production details;
• provenance where available; and
• comparison against known genuine examples.

The terms “authentic”, “genuine”, “original” or “official” mean that the underlying merchandise is genuine merchandise produced or authorised by the relevant manufacturer or rights holder.

These terms do not automatically mean that an item is:

• match-worn;
• player-worn;
• player-issued;
• match-issued;
• match-prepared; or
• otherwise associated with a particular player or match.

We will only use these collector-specific descriptions where we reasonably believe there is sufficient evidence to support them.

An officially licensed retail “replica” jersey may still be a genuine product. An official replica should not be confused with a counterfeit or unauthorised reproduction.

Where we are aware that a nameset, number, sponsor, badge, patch, repair or other modification is later-applied, replaced or non-original, and we consider that information material to a collector, we will make reasonable efforts to disclose it.

If you reasonably believe that an item sold by us as genuine is counterfeit, please contact info@thevarhk.com with your order number and supporting information.

If we determine that an item sold by us as genuine was counterfeit, we will provide a monetary refund of the purchase price and the standard shipping charge originally paid for that item. Where return of the item is required, we will also cover reasonable return shipping costs.

4. Product Descriptions

We make reasonable efforts to ensure product information is accurate.

Listings may include information relating to:

• season or approximate year;
• club or national team;
• manufacturer;
• model;
• tagged size;
• condition;
• nameset and numbering;
• patches and badges; and
• other relevant characteristics.

Due to the age of some vintage products, certain historical information may not be capable of absolute verification.

Where appropriate, we may use descriptions such as “circa”, “believed to be”, “approximately”, “likely” or similar qualifying language.

Customers should carefully review the product description and photographs before purchasing.

5. Sizing and Fit

Vintage sizing may vary significantly between brands, countries, production periods and individual garments.

A tagged size on a vintage item may therefore fit differently from the same tagged size on a modern garment.

Customers are responsible for reviewing the tagged size and any other sizing information provided in the product listing before purchasing.

Returns, exchanges, refunds and store credit will not be provided solely because an item does not fit as expected, the customer selected the wrong size, or the customer prefers a different fit, provided that the tagged size or other sizing information stated in the product listing was accurate.

Sizing and fit issues are therefore not eligible for our discretionary return or store-credit policy.

This restriction does not apply where:

• we incorrectly stated the tagged size or other sizing information;
• we sent the wrong item; or
• applicable law requires another remedy.

6. Prices and Currency

Prices are displayed in the currency shown on our website or sales channel.

Prices may change before an order has been accepted.

Your bank, card issuer or payment provider may apply its own exchange rate or charges.

Unless expressly stated otherwise, international customs duties, import taxes, VAT/GST, brokerage charges and similar destination-country charges are not included in the price.

If an obvious pricing or listing error occurs, we may contact you to correct the transaction or cancel the affected order and refund the amount paid.

7. Orders

Submitting an order constitutes an offer to purchase the relevant item.

An automated order acknowledgement does not necessarily mean that your order has been accepted.

We may accept an order by confirming acceptance, commencing fulfilment or dispatching the item.

Because many vintage products are unique one-off items and may be offered through more than one sales channel, an item may occasionally become unavailable after an order has been submitted.

If we cannot fulfil an order, we will refund the amount paid for the unavailable item.

We may reasonably refuse or cancel an order in circumstances including:

• suspected fraud;
• unauthorised payment;
• payment failure;
• product unavailability;
• an obvious pricing or listing error; or
• misuse of our website or services.

8. Payment

Orders must be paid using one of the payment methods offered by us.

You are responsible for providing accurate payment information and for being authorised to use your selected payment method.

Third-party payment providers may apply their own terms.

9. Shipping and Delivery

Available shipping methods, charges and estimated delivery times will be shown at checkout or communicated before purchase.

Delivery times are estimates unless expressly guaranteed.

Shipping may be affected by customs procedures, courier delays, postal delays, weather, public holidays or circumstances outside our reasonable control.

Customers are responsible for providing a complete and accurate delivery address.

If a parcel is returned because of an incorrect or incomplete address, refusal of delivery or failure to collect the parcel, we may require payment of reasonable additional shipping costs before resending it.

10. International Orders

International customers are responsible for checking applicable import restrictions.

The recipient may be responsible for:

• customs duties;
• import taxes;
• VAT/GST;
• brokerage fees; and
• other destination-country charges.

These charges are not controlled by Vintage Authentic Room.

11. Returns, Store Credit and Refunds

Our separate Returns & Refunds Policy forms part of these Terms.

Outside mandatory statutory rights:

• returns are considered case by case;
• approval is not guaranteed;
• approved discretionary returns receive store credit only;
• discretionary returns do not receive cash refunds or refunds to the original payment method;
• store credit expires 30 calendar days from the date of issuance; and
• sizing and fit issues are not eligible for discretionary returns, exchanges, refunds or store credit where the sizing information we provided was accurate.

12. Garment Care

Vintage garments may be more delicate than modern garments.

Customers should follow garment care labels and use appropriate care when washing, cleaning, drying, ironing, wearing or storing products.

Except where applicable law provides otherwise, we are not responsible for damage or deterioration caused after delivery by improper cleaning, washing, drying, alteration, storage, misuse or normal wear and tear.

13. Intellectual Property

The Vintage Authentic Room name, branding, original photography, product descriptions, website content and other original materials created by or for us are owned by or licensed to Vintage Authentic Room Limited.

They may not be copied or commercially reproduced without permission.

Club names, competition names, manufacturer names, player names, logos, badges and third-party trademarks remain the property of their respective owners.

Our resale of genuine merchandise does not imply sponsorship, endorsement, partnership or official affiliation with any club, league, federation, manufacturer or player unless expressly stated.

14. Third-Party Services

We may use or link to payment providers, couriers, social media platforms, marketplaces and other third-party services.

Those services may operate under their own terms and privacy policies.

We are not responsible for their independent operation.

15. Limitation of Liability

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

To the maximum extent permitted by law, we are not responsible for indirect or consequential loss that was not reasonably foreseeable when the relevant contract was entered into.

Nothing in these Terms limits liability for fraud, fraudulent misrepresentation or any liability that applicable law prohibits us from limiting.

16. Events Outside Our Reasonable Control

We are not responsible for delays or failures caused by circumstances outside our reasonable control, subject to applicable law.

These may include significant transportation disruption, natural disasters, government action, customs disruption, telecommunications failures or similar events.

17. Privacy

Our collection and use of personal information is governed by our Privacy Policy.

18. Governing Law

These Terms and contracts entered into with Vintage Authentic Room Limited are governed by the laws of the Hong Kong Special Administrative Region.

This does not deprive a consumer of mandatory rights under any applicable law that cannot lawfully be excluded by agreement.

Subject to such mandatory rights, the courts of Hong Kong shall have jurisdiction over disputes relating to these Terms.

19. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in effect.

20. Changes to These Terms

We may update these Terms from time to time.

The version generally applicable to an order is the version in effect when the order was placed, unless applicable law requires otherwise.

閣下瀏覽本網站、提交訂單或向我們購買商品，即表示同意受本條款約束。

本條款任何內容均不會排除或限制任何根據適用法律不能合法排除或限制的消費者權利或補救。

2. 復古及二手商品

我們出售的許多商品屬復古、二手、停產或收藏商品。

由於商品的年份及歷史，可能存在褪色、勾線、線頭、污漬、痕跡、印字龜裂、修補或其他正常老化及使用痕跡。

我們會盡合理努力在商品描述及照片中披露重要瑕疵及明顯狀況問題。

如某項狀況已於購買前清楚披露，該情況本身一般不代表商品與描述不符。

除非另有說明，商品照片原則上顯示實際出售的該件商品。

3. 真品保證

Vintage Authentic Room 保證所有由我們以真品、正品、Authentic 或 Genuine 名義出售的商品均為真品，並非假冒商品。

我們可能根據以下合理可取得的資料判斷商品真偽：

• 品牌及製造商資料；
• 產品編號；
• 標籤及洗水標；
• 物料；
• 車工及製作方式；
• 設計特徵；
• 生產資料；
• 商品來源資料；及
• 與已知真品作比較。

「Authentic」、「Genuine」、「Original」、「真品」、「正品」或「官方產品」代表相關商品本身為由相關製造商或權利持有人生產或正式授權生產的真品。

上述描述並不自動代表商品屬：

• Match Worn；
• Player Worn；
• Player Issue；
• Match Issue；
• Match Prepared；或
• 曾與某一指定球員或賽事直接相關。

我們只會在合理相信有足夠證據支持時使用上述收藏級描述。

正式授權的零售版「Replica」球衣仍可屬真品，並不等同假冒或未經授權的仿製品。

如我們知悉印字、號碼、贊助商、徽章、臂章、修補部分或其他修改屬後期加上、更換或非原裝，而且我們認為該資料對收藏者而言重要，我們會盡合理努力作出披露。

如閣下有合理理由懷疑由我們以真品形式出售的商品是假貨，請透過 info@thevarhk.com 聯絡我們。

如經我們確認商品屬假冒商品，我們會提供該商品購買價及原先支付的標準運費之金錢退款。

如需要退回商品，我們亦會承擔合理退貨運費。

4. 商品描述

我們會盡合理努力確保商品資料準確。

商品描述可能包括：

• 球季或約略年份；
• 球會或國家隊；
• 品牌；
• 款式；
• 標籤尺碼；
• 商品狀況；
• 印字及號碼；
• 臂章及徽章；及
• 其他相關特徵。

由於部分復古商品已有多年歷史，某些歷史資料可能無法完全確認。

在適當情況下，我們可能使用「約」、「相信為」、「推定」、「可能為」、「Circa」等限定描述。

顧客應於購買前仔細閱讀商品描述及查看所有照片。

5. 尺碼及穿著效果

不同品牌、國家、生產年代及個別商品之間的復古球衣尺碼可能存在明顯差異。

同一標籤尺碼的復古商品，其穿著效果可能與同一尺碼的現代商品有所不同。

顧客有責任於購買前查看商品頁面所列出的標籤尺碼及任何其他尺碼資料。

如商品頁面所列出的標籤尺碼或其他尺碼資料準確，我們不會單純因為商品穿著效果與預期不同、顧客選擇錯誤尺碼，或顧客希望選擇其他版型，而接受退貨、換貨、退款或提供購物額（Store Credit）。

因此，尺碼或穿著效果問題不適用於我們的酌情退貨及購物額政策。

上述限制不適用於：

• 我們錯誤列出尺碼資料；
• 我們寄出錯誤商品；或
• 適用法律規定必須提供其他補救。

6. 價格及貨幣

商品價格以網站或相關銷售渠道所顯示的貨幣列出。

在訂單正式接受前，我們可更改商品價格。

銀行、信用卡公司或付款服務供應商可能採用其自身匯率或收取費用。

除非另有明確說明，關稅、進口稅、VAT／GST、清關費及目的地國家或地區收取的其他費用並不包括在商品價格內。

7. 訂單

提交訂單即代表閣下提出購買相關商品的要約。

自動訂單確認通知並不一定代表訂單已被我們正式接受。

由於許多復古商品屬獨一件商品，並可能同時於不同渠道出售，商品可能在訂單提交後變得無法供應。

如我們無法履行訂單，我們會退還無法供應商品的已支付款項。

我們可在合理情況下拒絕或取消訂單，包括：

• 懷疑欺詐；
• 未經授權付款；
• 付款失敗；
• 商品無法供應；
• 明顯定價或刊登錯誤；或
• 濫用網站或服務。

8. 付款

訂單須透過我們提供的付款方式支付。

顧客須提供準確的付款資料，並確保有權使用相關付款方式。

9. 運送及送貨

可供選擇的運送方式、運費及預計送達時間將於結帳頁面顯示或在購買前提供。

除非另有明確保證，所有送貨時間均屬估計。

實際送達時間可能受海關、速遞、郵政、天氣、公眾假期或其他超出我們合理控制範圍的情況影響。

顧客有責任提供完整及準確的送貨地址。

10. 國際訂單

國際顧客有責任確認目的地的相關進口限制。

收件人可能需要自行支付：

• 關稅；
• 進口稅；
• VAT／GST；
• 清關費；及
• 其他目的地費用。

Vintage Authentic Room 並不控制上述費用。

11. 退貨、購物額及退款

我們另行公布的**《退貨與退款政策》**構成本條款的一部分。

除強制性法定權利外：

• 所有退貨均按個別個案審批；
• 提交退貨申請並不保證獲批准；
• 經批准的酌情退貨只會提供購物額(Store Credit)；
• 不會就酌情退貨提供現金退款或退回原付款方式；
• 購物額由發出日期起計 30 個曆日後到期；及
• 如我們提供的尺碼資料準確，尺碼或穿著效果問題不適用於酌情退貨、換貨、退款或購物額。

12. 商品保養

復古商品可能較現代商品脆弱。

顧客應遵從洗衣標籤及使用適當方式穿著、清洗、乾衣、熨燙及存放商品。

13. 知識產權

Vintage Authentic Room 的名稱、品牌、原創照片、商品描述及網站內容均由 Vintage Authentic Room Limited 擁有或獲合法授權使用。

第三方球會名稱、品牌名稱、球員姓名、徽章、商標及其他知識產權仍屬相關權利持有人所有。

14. 第三方服務

我們可能使用付款平台、速遞服務、社交媒體、網上市場及其他第三方服務。

該等服務可能受其自身條款及私隱政策規管。

15. 責任限制

本條款不會排除或限制任何法律上不能合法排除或限制的責任。

在法律允許的最大範圍內，我們不會為訂立合約時無法合理預見的間接或後果性損失負責。

16. 超出合理控制範圍的事件

如延誤或未能履行責任是由超出我們合理控制範圍的情況所造成，在適用法律允許的情況下，我們一般不承擔責任。

17. 私隱

我們處理個人資料的方式受本公司的**《私隱政策》**規管。

18. 適用法律

本條款及閣下與 Vintage Authentic Room Limited 訂立的合約均受香港特別行政區法律管轄。

本條款不會剝奪消費者根據不能合法排除的適用法律所享有的強制性權利。

19. 可分割性

如本條款任何部分被裁定無效或不可執行，其餘條文仍繼續有效。

20. 條款更新

我們可能不時更新本條款。
